Terms of Service

These Terms of Service (hereinafter the "Terms") govern the use of the Telvin Bot service (hereinafter the "Service"), accessible via Telegram and the website Telvin Bot.com.

Any use of the Service implies full and unconditional acceptance of these Terms by the User. These Terms prevail over any other document.

The Publisher reserves the right to modify these Terms at any time. Modifications take effect upon their publication on the website. The User is encouraged to regularly review the latest version of the Terms.

In these Terms, the following terms have the meanings set forth below:

• Service: refers to the Telvin Bot service that allows users to receive personalized alerts for items listed for sale on the Vinted platform.
• User: refers to any individual or legal entity using the Service.
• Account: refers to the User's personal space within the Service.
• Subscription: refers to the paid plan granting access to the premium features of the Service.
• Alert: refers to the notification sent to the User when an item matching their criteria is listed for sale on Vinted.

Telvin Bot is a service that allows Users to receive personalized alerts when items matching their search criteria are listed for sale on the Vinted platform.

The Service offers:

• Free access with limited features (1 active alert)
• Paid subscription plans (Starter, Premium, and Pro) with advanced features
• Alert delivery via the Telegram platform
• A custom URL generator for Vinted
• A referral program that allows users to earn credits

The Publisher reserves the right to modify the features of the Service at any time, without prior notice and without entitling the User to any compensation.

To use the Service, the User must have a Telegram account and follow the registration process indicated on the website or via the Telegram bot.

The User agrees to provide accurate information and to keep it up to date. The Publisher shall not be held liable for any consequences arising from the provision of inaccurate information.

The User is solely responsible for maintaining the confidentiality of their account and for all actions performed through it. The User must immediately notify the Publisher of any unauthorized use of their account.

The Publisher reserves the right to suspend or delete an account in the event of a breach of these Terms, without prior notice or compensation.

The Service offers various subscription plans, the prices of which are listed on the website. All prices are quoted in euros and include all applicable taxes.

The available subscription plans are:

• Free: 1 alert (keyword)
• Starter: 4.90€/month — 2 alerts (keyword), alerts in 750ms ⚡, support included
• Premium: 8.90€/month — 5 alerts (URL filters), alerts in 750ms ⚡, priority support
• Pro: 14.90€/month — 10 alerts (URL filters), alerts in 750ms ⚡, priority support

Payment is made by credit card through our secure payment provider Stripe. Banking data is encrypted and does not pass through the Publisher's servers.

The subscription is automatically renewed at the end of each period, unless cancelled by the User at least 48 hours before the renewal date.

The Publisher reserves the right to modify its prices at any time. New prices will apply upon subscription renewal, unless the User objects by cancelling their subscription.

The Service offers a referral program that allows Users to refer new members and receive benefits in return.

For each new member who subscribes using the User's referral code, the User receives a 5€ credit applied to their next invoice, and the referred member receives a 5€ discount on their subscription.

The User may not use their own referral code. Any attempt to defraud the referral program may result in account suspension and cancellation of accrued benefits.

Credits earned through the referral program are automatically deducted from the User's next invoice. They cannot be converted to cash or transferred to another account.

The Publisher reserves the right to modify or discontinue the referral program at any time, without prior notice or compensation.

The Service relies on independent third-party platforms, in particular Vinted and Telegram, over which the Publisher has no control. The User expressly acknowledges and accepts that the proper functioning of the Service is contingent on the availability and stability of these platforms.

In the event of any modification, restriction, interruption, or discontinuation of Vinted's or Telegram's API or features that renders the Service partially or entirely unavailable, the Publisher shall not be held liable and no automatic refund shall be due.

The Publisher undertakes to inform Users as promptly as possible of any major disruption caused by these platforms and to make all reasonable efforts to restore the Service as quickly as possible.

In the event of a prolonged interruption of the Service attributable to a third-party service, refund requests will be examined on a case-by-case basis by the Publisher, without this constituting an automatic right for the User. Users may contact the Publisher at contact@telvin-bot.com to explain their situation.

The Service is provided "as is", without warranty of any kind. The Publisher does not warrant that the Service will be uninterrupted, secure, or error-free.

The Publisher cannot guarantee the completeness of alerts sent and shall not be held liable if certain listings published on Vinted do not trigger an alert.

The Publisher is not responsible for the content of Vinted listings relayed by the Service, nor for transactions between the User and sellers on Vinted.

The Publisher's liability shall not be engaged for any indirect damages suffered by the User, such as loss of opportunity, loss of revenue, or loss of data.

In any event, should the Publisher's liability be established, the amount of compensation shall not exceed the total amounts paid by the User during the preceding 12 months.

In accordance with article L221-18 of the French Consumer Code, the User has a period of 14 calendar days from the date of subscription to exercise their right of withdrawal, without having to provide any reason or pay any penalty.

To exercise this right, the User must notify the Publisher of their withdrawal decision by email at contact@telvin-bot.com before the 14-day period expires. The Publisher will process the refund within 14 days of receiving the request, using the same payment method as the one used at the time of subscription.

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium where execution has begun with the User's prior express consent and express waiver of their right of withdrawal.

The User may cancel their subscription at any time from their personal space or by contacting customer support. Cancellation will take effect at the end of the current subscription period.

No refund will be issued for the current subscription period, unless otherwise required by applicable law.

The Publisher reserves the right to unilaterally terminate a User's subscription in the event of:

• Breach of these Terms
• Fraudulent or abusive use of the Service
• Payment default
• Provision of inaccurate information

In the event of termination due to User fault, no refund will be issued.

The Publisher collects and processes Users' personal data in accordance with its Privacy Policy, available on the website.

The data collected is necessary for the provision of the Service and the processing of payments. It may also be used for the purpose of improving the Service and communicating with the User.

In accordance with the General Data Protection Regulation (GDPR), the User has the right to access, rectify, erase, and port their data, as well as the right to object to or restrict the processing of their data. These rights may be exercised by contacting the Publisher at contact@telvin-bot.com.

All elements comprising the Service (text, images, logos, code, etc.) are protected by intellectual property law and are the exclusive property of the Publisher.

Any reproduction, representation, modification, publication, adaptation, or exploitation of all or part of the elements of the Service, by any means whatsoever, without the prior written authorization of the Publisher, is strictly prohibited and constitutes infringement.

The User agrees not to circumvent the technical protection measures implemented by the Publisher to secure the Service.

These Terms are governed by and construed in accordance with French law.

In the event of a dispute relating to the interpretation or performance of these Terms, the User is encouraged to first contact the Publisher to seek an amicable resolution.

In accordance with consumer protection regulations regarding the amicable settlement of disputes, the User may resort free of charge to the FEVAD e-commerce mediator: www.mediateurfevad.fr.

In accordance with European regulation No. 524/2013, the User may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.

Failing an amicable resolution, any dispute shall be submitted to the competent French courts.
